Introduction

Please read the following terms and conditions carefully. You must not make any booking unless you understand and agree with the following terms and conditions. These terms and conditions apply to bookings you the Traveller makes with LOCO Journeys Limited that you have engaged in person, on the phone or by email to conclude your travel details and itinerary.

We will rely on the authority of the party making a booking to act on behalf of any other party involved and the party making the booking will bind all involved Travellers to these terms and conditions.

References to the ‘Traveller’ refer to you, our customer. Reference to the Supplier refers to suppliers to LOCO Journeys Limited.


Service Commitment

LOCO Journeys Limited will provide services with a commitment to deliver them with reasonable care and skill, fit for purpose, charged at a reasonable price and completed within a reasonable time.


Agency & Suppliers

LOCO Journeys acts as an agent for and sell various travel related products as an agent on behalf of various Suppliers such as transportation, accommodation, and other service providers, including airlines, coach, rail and cruise line operators, as well as wholesalers.

Any services LOCO Journeys provides to you the Traveller are collateral to that agency relationship. Our obligation to the Traveller is to (and you expressly authorise us to) make travel bookings on your behalf and to arrange relevant contracts between you the Traveller and travel service Suppliers. We exercise care in the selection of reputable service providers, but we are not ourselves a provider of travel services and have no control over, or liability for, the services provided by third parties Suppliers.

All bookings are made on the Travellers behalf subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by these service Suppliers. We can provide Travellers with copies of the relevant service provider terms and conditions on request.

Your legal rights in connection with the provision of travel services are against the specific Supplier and, except to the extent a problem is caused by fault on our part, are not against us.

Specifically, if for any reason (excluding fault on our part) any travel service Supplier is unable to provide the services for which you have contracted, your rights are against that Supplier and not against us.


Prices & Costs

All prices are subject to availability and can be withdrawn or varied without notice. In most instances, the price shown on this website are a guide price only. Please note that prices quoted are per person, credit card surcharges may apply, and prices are subject to change.

Price changes may occur by reason of matters outside the control of LOCO Journeys Limited which increase the cost of the product or service. Such factors include adverse currency fluctuations, fuel surcharges, taxes, supplier tariff increases, and airfare increases.

Prices will be quoted in New Zealand dollars, unless specifically stated otherwise. Goods and Services tax (GST) is included in all prices at 15% (subject to government change).

Advertised tour prices are always shown as ‘From’ as Supplier tour pricing is variable, and an exact price may not be available on the departure upon which you the Traveller wish to travel.

To our best endeavours, all information is correct at time of publishing.

LOCO Journeys Limited reserves the right to vary or correct any pricing errors or omissions and apply or withdraw surcharges at any time.


Reservations

The Traveller’s booking is made with LOCO Journeys Limited. By booking with LOCO Journeys Limited, the Traveller is deemed to have agreed to these Terms and Conditions and the booking will be accepted by LOCO Journeys Limited on this basis. The services that LOCO Journeys Limited provide are those referred to in the Traveller’s booking confirmation invoice.

For LOCO Journeys Limited to confirm any travel arrangements, the Traveller must provide all requested booking details along with either a deposit or full payment. Necessary details required may include full name as per passport, date of birth, nationality, passport number, passport issue and expiry dates, plus details of any pre-existing medical conditions which may affect the Traveller’s ability to complete their travel arrangements.


Deposits & Payment

The Traveller will be required to pay a non-refundable deposit or in certain instances, full payment when making a booking. LOCO Journeys Limited will advise how much is due at the time of booking.

As an indication, full payment is normally due at least 60 days prior to departure from the country of origin. Payment must be made in full if inside the 60 day period. All deposits are non-refundable for cancellations made by the Traveller.


Cancellation & Amendment Fees

Cancelled bookings, amendment requests, travel changes and ticket reissues are likely to incur fees from either LOCO Journeys Ltd and/or Suppliers which may be up to 100% of the cost of the booking.

LOCO Journeys reserves the right to charge up to $200 per person for cancelling your reservation. Any further fees liable for cancellations or amendments from suppliers will be passed directly onto the Traveller.

Any refund requests will be subject to the booking conditions of the Supplier. No refunds (if any refund is due at all) will be paid until money is received from the Supplier. LOCO Journeys holds no liability as to how promptly the Supplier will pay any refund.


Service Fees

LOCO Journeys does not typically charge service fees in addition to the cost of your trip.

Nevertheless, where LOCO Journeys has provided the Traveller extensive and complete travel services to the point of booking without a booking eventuating and without reasonable cause, LOCO Journeys Ltd at its discretion reserves the right to charge up to $200 per person for professional services offered and time furnished.



Passports & Visas

It is the responsibility of the Traveller to ensure they are in possession of valid travel visas and passports. Most countries require passports to be valid for at least six months after return to the point of origin. LOCO Journeys Limited will provide advice only as to visa requirements the Traveller will need to satisfy to enter their intended destination; meeting those requirements will be the sole responsibility of the Traveller. LOCO Journeys Limited accepts no responsibility if the Traveller is unable to travel due to not holding a valid passport or visa and will not be held liable to provide any refund.


Travel Documents

Travel documents include (but are not limited to), air tickets, tour and hotel vouchers, itineraries, insurance certificates and any other documentation specifically issued by a Supplier. Travel documents are not transferable or refundable.

Travel documents will be issued to the Traveller only once full payment has been received and will be dispatched to the Traveller as they become available from the Supplier. It is the responsibility of the Traveller to ensure they have their travel documents in hand prior to departure and all the details contained in the documents are correct. All documentation, particularly airline tickets must be issued in the Traveller’s name as it appears in their passport. LOCO Journeys Limited takes no responsibility for the loss of travel documents or any errors contained in documents if the Traveller failed to provide written advice at the time of booking.


Luggage & Possessions

LOCO Journeys Limited does not accept liability for loss of luggage or other possessions. Luggage allowances are subject to the conditions of the Suppliers Conditions of Carriage.


Travel Insurance

Travel Insurance is a compulsory booking requirement of all LOCO Journeys Limited featured Suppliers and it is recommended that this should be purchased at the time of booking. In most instances, the Traveller will be asked to provide proof of their travel insurance before their trip commences. LOCO Journeys consultants can provide a comprehensive travel insurance quote at the time of booking.


Itinerary

The Suppliers package described in the Traveller’s confirmed itinerary is correct at the time of publication and will be adhered to within reason by the Supplier but may be changed due to weather, safety conditions, or at the discretion of the Supplier. Changes to the itinerary or the use of third party Suppliers shall not give the Traveller a right of cancellation.


Accommodation

Accommodation listed in itineraries is the price of a twin share with private facilities unless otherwise indicated. Exceptions to the accommodation standard will occur should a tour overnight in a home-stay or on a train for example. Suppliers reserve the right to alter accommodation to the same standard according to availability and in the best interests of Traveller’s and such substitutions shall form part of their conditions of carriage.



Termination of Tour

Traveller’s committing an illegal act or breaching local territory health and safety legislation (being a danger to themselves or others), or in any way breaching the local Suppliers conditions of carriage will be removed from the tour and no refund will be due.


Connections and 3rd Party Operators

LOCO Journeys Limited does not accept liability for delays in transit or failure to connect with Traveller’s expectations for further connection to or from any third-party Supplier including airlines, rail or other coach lines.

LOCO Journeys Limited does not accept liability for any Suppliers activities and accommodation or their reliability or safety standards.


Feedback

If a problem occurs during a tour then in your own best interests the Traveller should either contact the Supplier or LOCO Journeys Limited immediately so that steps can be taken to resolve the matter on the spot, there and then.


Photographs & Information

The photographs reproduced and information provided on this website depict typical scenes experienced, but the subject matter may not necessarily be seen or experienced whilst visiting that destination.

The Traveller consents to any images, still or otherwise taken during their tour to be used by LOCO Journeys Limited for promotional purposes in any medium, royalty-free in perpetuity.

Upon booking, the Traveller consents to their email address being added to the LOCO Journeys newsletter for the purposes of receiving relevant information about their tour, future tours and promotions.


International Travel Advice

LOCO Journeys Limited recommend all Traveller’s seek official advice on travelling overseas at the Safe Travel website safetravel.govt.nz to fully understand the risks of travel in their intended destination.


Liability of Loco Journeys Limited

LOCO Journeys Limited acts as an agent only. The warranty to the Traveller shall only be the warranty of LOCO Journeys Limited to provide travel services under these conditions of carriage

LOCO Journeys Limited and any Supplier connecting to or providing holiday services are independent of each other. LOCO Journeys Limited as a New Zealand travel agent will only accept bookings from the Traveller on the conditions that LOCO Journeys Limited will not accept liability for the operations of any Supplier including personal injury or illness to the Traveller, loss of property, loss from delay or inconvenience to the Traveller or any person caused by the actions of any Supplier of the Traveller.

In the event that there is any inconsistency between these terms and conditions and any other LOCO Journeys Limited or Supplier documentation, these terms and conditions will prevail.

LOCO Journeys Limited shall not be liable for any breach or failure to perform any of its obligations under these terms of carriage where such breach or failure is caused by war, civil commotion, hostilities, strike or lockout, act of God, fire, governmental regulations or directions, mechanical breakdowns or any other cause force majeure beyond the reasonable control of LOCO Journeys Limited. The occurrence of such an event shall not give the Traveller a right of cancellation of the contract.
